Terms of Service

These Terms of Service apply to the Aware Index website and services provided by SmartSec Academy OÜ. By requesting, ordering or using an Aware Index service, you agree to these Terms.

In these Terms, "Aware Index", "we", "us" and "our" refer to SmartSec Academy OÜ. "You" and "client" refer to the business, organisation or professional requesting or purchasing a service and, where relevant, its authorised representative.

2. Business use only

Aware Index services are intended for businesses, organisations and individuals acting for professional or commercial purposes. They are not offered to consumers purchasing for personal, family or household use. If mandatory rights apply despite this restriction, nothing in these Terms removes rights that cannot legally be excluded.

You confirm that you are at least 18 years old and have authority to act for the business or organisation identified in the request or order.

3. What Aware Index provides

Aware Index provides snapshot-in-time, human-reviewed assessments of public business information, selected AI/search outputs and visible trust signals. Services may include:

• A Free AI Trust Snapshot, which is a limited introductory review.
• A paid AI Trust Clarity Report, which is a broader customised review delivered digitally.
• Optional implementation, correction or advisory work, but only where separately agreed in writing and separately quoted.

The exact scope, price and any service-specific information shown on the website, intake form, payment page or written quotation form part of the agreement for that service.

4. Free AI Trust Snapshot

Submitting a request does not guarantee selection, review or delivery. Free snapshots are offered in limited batches and may be prioritised or declined based on capacity, suitability, available public information and operational considerations.

A free snapshot is limited, non-exhaustive and provided for general business information. We may change, pause or withdraw the free service at any time. No payment is required and no ongoing service relationship is created unless separately agreed.

5. Paid AI Trust Clarity Report

A paid report is a customised digital professional service based on the agreed scope, public information available at the time of review and the information you provide. The current price and any applicable taxes are displayed before purchase.

Paid reports are one-time purchases. They are not subscriptions and do not renew automatically.

Unless otherwise agreed in writing, the report does not include website changes, profile updates, technical implementation, ongoing monitoring, search engine optimisation, advertising services or guaranteed placement in any third-party system.

6. Orders and acceptance

An order is accepted when we confirm it by email or begin the service after receiving payment and the information reasonably required to perform the review. An automated payment receipt alone does not require us to accept an unsuitable or unlawful request.

We may decline or cancel an order where the request is outside scope, unlawful, abusive, misleading, creates a conflict, requires access we do not have, or cannot reasonably be delivered. If we cancel an accepted paid order before delivery for reasons not caused by you, we will refund the amount paid for that service.

7. Information and cooperation required from you

You agree to provide accurate, current and complete information and to respond reasonably promptly to questions needed to deliver the service. You confirm that you have the authority to submit the business information and request the review.

Do not send passwords, payment card data, confidential credentials, special category personal data or private information that is not necessary for the review. You are responsible for checking that any information you provide may lawfully be shared with us.

If required information is missing, inaccurate or delayed, the delivery timetable is paused until the issue is resolved. We are not responsible for conclusions affected by incomplete, outdated or misleading information supplied by you or shown publicly by third parties.

8. Payment, taxes and invoices

Paid services must be paid in full before work begins unless a written quotation states otherwise. Payments may be processed by Stripe or another payment provider identified at checkout. We do not store full payment card details.

Prices and applicable VAT or other taxes, if any, are shown before payment or on the invoice. You are responsible for supplying accurate billing and tax information.

9. Delivery

Unless otherwise agreed, a paid report is targeted for delivery within five working days after both payment and receipt of all required information. A working day means Monday to Friday, excluding public holidays in Estonia.

Delivery times are reasonable estimates, not guarantees. We will notify you if a material delay becomes apparent. Reports are normally delivered electronically to the email address provided.

Requests to correct a clear factual error should be sent within seven calendar days after delivery. We will review substantiated factual correction requests. Changes to scope, additional research, repeated checks or implementation work may require a separate quotation.

10. Cancellation and refunds

You may cancel a paid report and receive a full refund if we receive the cancellation before review work has started. Work starts when we begin research, testing, analysis or preparation for your report.

Once work has started, payments are non-refundable except where required by law or where we are unable to deliver the agreed service. If part of the work has been completed and a refund is agreed, we may deduct a reasonable amount reflecting work already performed where permitted by law.

11. Snapshot-in-time nature of the service

Every snapshot and report reflects selected public information and selected AI/search checks at a particular time. AI systems, search results, directories, websites, reviews and public profiles can change without notice. Results may also vary by platform, location, timing, prompt wording, account settings, personalisation and system updates.

A report is not continuous monitoring and does not promise that the same result will appear later or for another user. We do not treat a single automated output as fixed truth. Findings are reviewed by a person, but professional judgement does not remove uncertainty.

12. No guarantees and no regulated advice

Aware Index does not guarantee:

• Search rankings, AI recommendations, citations or inclusion in third-party AI/search systems.
• Increased traffic, leads, enquiries, sales, revenue, reputation or other commercial outcomes.
• That a platform, search engine, directory or AI service will accept, retain, display or change information.
• That every issue, inconsistency or opportunity will be identified.

The service is not legal, financial, tax, investment, cybersecurity testing or regulated professional advice. It is not a technical security audit, certification, accreditation, endorsement or guaranteed SEO service. You should obtain specialist advice where a decision requires it.

13. Your decisions and implementation

Reports contain observations and recommendations, not instructions that must be followed. You remain responsible for deciding whether, when and how to act on them, checking their suitability for your business and maintaining your own legal, technical and professional compliance.

Any implementation work is outside the report unless separately agreed in writing. We are not responsible for changes made by you, your contractors or third parties, or for the consequences of relying on outdated third-party information.

14. Third-party services and content

The service depends partly on third-party websites, AI tools, search engines, directories, social platforms, review platforms and payment or form providers. We do not control their availability, rules, outputs, ranking methods, security, content or future changes.

Links or references to third parties are provided for context and do not mean that Aware Index endorses them or accepts responsibility for their services.

15. Intellectual property and permitted use

Aware Index and SmartSec Academy OÜ retain all rights in our branding, templates, methodology, report structure, prompts, explanatory text, design elements and general know-how. Your business retains ownership of the material and information you provide.

After full payment, you receive a non-exclusive, non-transferable licence to use the final report for your own internal business purposes and to share it with your employees and professional advisers. You may accurately quote or share findings externally, provided that you do not alter them misleadingly or suggest that the report is a ranking, certification, endorsement or guarantee.

You may not resell, republish as a competing product, remove ownership notices from, systematically copy, reverse engineer or use our materials to create a substantially similar commercial service without written permission.

16. Confidentiality

We will treat non-public information you provide as confidential and use it only to deliver and administer the service, except where disclosure is required by law or reasonably necessary to professional advisers or service providers under appropriate obligations.

This obligation does not apply to information that is already public, was lawfully known without restriction, is independently developed, or is lawfully received from another source.

17. Liability

Nothing in these Terms excludes or limits liability that cannot legally be excluded, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence where applicable.

To the maximum extent permitted by law, Aware Index is not liable for indirect, incidental, special or consequential loss, or for loss of profit, revenue, opportunity, anticipated savings, goodwill, reputation or data arising from the service, third-party platforms, or decisions made using a snapshot or report.

To the maximum extent permitted by law, our total aggregate liability arising from a paid service is limited to the amount you paid for the specific service giving rise to the claim. No monetary liability arises from a free snapshot except where liability cannot legally be excluded.

18. Suspension and acceptable use

You must not use the website or services unlawfully, attempt to disrupt or compromise them, submit malicious content, impersonate another organisation, misuse a report to mislead others, or request a review for harassment, surveillance or other improper purposes.

We may suspend communication, decline a request or terminate a service where these Terms are materially breached, subject to any refund obligations that apply.

19. Events outside reasonable control

We are not responsible for delay or failure caused by events outside our reasonable control, including outages, provider failures, cyber incidents, legal restrictions, natural events or widespread service disruption. We will take reasonable steps to reduce the effect and resume delivery where practical.

20. Changes to services and Terms

We may update the website, service descriptions, prices or these Terms. The Terms in effect when an order is accepted apply to that order unless a change is required by law or agreed with you. Changes do not create a subscription or retroactive obligation.

21. Governing law and disputes

These Terms and any non-contractual obligations arising from them are governed by Estonian law. The courts of Estonia have exclusive jurisdiction, except where mandatory law requires otherwise.

Before starting formal proceedings, both parties should first try in good faith to resolve the issue through written communication.

22. General terms

If any provision is found unenforceable, the remaining provisions continue in effect. A delay in enforcing a right is not a waiver of that right. You may not transfer your rights or obligations under these Terms without our written consent. We may transfer them as part of a reorganisation, sale or transfer of the relevant business, provided this does not materially reduce your rights.
